Buyer Terms & Conditions
Last updated: October 2026
Welcome to Droply — a curated online art space showcasing original artworks by Australian artists.
We bring together thoughtfully selected collections of original art, making it easier to discover artists and collect something you love.
These Terms & Conditions explain how purchasing through droply.au works, including orders, payment, shipping, returns and refunds.
By placing an order through Droply, you agree to these Terms & Conditions. Nothing in these terms excludes or limits your rights under the Australian Consumer Law (ACL).

1. About Droply
Droply is an online art platform operated by DROPLY, ABN , 15 004 883 878. (“Droply”, “we”, “us” or “our”).
Droply curates and presents original artworks by independent Australian artists through limited seasonal collections, known as Drops.
Orders are placed through the Droply website. Depending on the artwork and fulfilment arrangements, the artist may prepare, package and dispatch the artwork directly to the buyer on Droply’s behalf.
Droply coordinates the purchasing process and assists buyers with order enquiries and issues in accordance with these terms and applicable consumer law.

2. Original artworks
Every artwork featured on Droply is individually created and may have unique textures, brushstrokes, marks, materials and other characteristics.
We take reasonable care to ensure artwork descriptions, dimensions, materials, prices and photographs are accurate.
Colours may appear slightly different depending on your screen, device settings, lighting and photography.
Any known imperfections or relevant characteristics will be described in the artwork listing where appropriate.
Minor differences inherent in an original artwork do not necessarily constitute a fault. However, nothing in this section limits your rights if an artwork does not meet a consumer guarantee.

3. Artwork availability
Droply features original and often one-of-a-kind artworks. Availability is therefore limited.
Adding an artwork to your cart does not reserve it. An order is subject to successful payment and confirmation.
If an artwork becomes unavailable after an order is placed, we will contact you and arrange a full refund for the unavailable artwork.

4. Pricing and payment
All prices are displayed in Australian dollars (AUD), unless otherwise stated.
Artwork prices and applicable shipping charges will be shown before you complete your purchase.
Payment must be completed through the payment methods available at checkout. Your order will be confirmed once payment has been successfully processed.
If a genuine pricing or listing error occurs, we will contact you to resolve the issue. We will not unilaterally substitute a different artwork for one you have purchased.

5. Shipping and packaging
Shipping is charged at $15 per artwork within Australia, unless a different charge is clearly displayed at checkout.
Each artwork attracts its own shipping and packaging allocation because artworks may be individually packaged and dispatched by different artists from different locations.
For example:
-
1 artwork = $15 shipping
-
2 artworks = $30 shipping
-
3 artworks = $45 shipping
These charges apply to the number of artworks purchased in a single transaction, not simply the number of orders placed.
If Droply offers a combined-shipping arrangement or promotional shipping rate, the applicable charge will be displayed at checkout.
The full shipping total will be shown before payment so you can review the cost before placing your order.
Shipping charges cover the applicable delivery and packaging allocation. Any additional delivery charges must be disclosed before you complete your purchase.

6. Dispatch and delivery
As Droply works with independent artists, artworks may be dispatched directly by the artist rather than from a central warehouse.
Artists are generally required to dispatch sold artworks within 3–5 business days, unless a different timeframe is stated for the artwork or communicated to you.
Where available, tracking details will be provided once your artwork has been dispatched.
Delivery times vary depending on your location, the delivery provider and circumstances outside our reasonable control. Dispatch timeframes are not guarantees of arrival dates.
If you purchase multiple artworks, they may arrive separately because they can be dispatched by different artists.
Please ensure your delivery address and contact details are correct at checkout. Contact us as soon as possible if you notice an error.
If an order is delayed, lost or delivered to the wrong address, please contact Droply so we can investigate and help resolve the issue.

7. Damaged, faulty or incorrect artworks
We expect every artwork to be carefully packaged and accurately represented.
If your artwork arrives damaged, is materially different from its description, is faulty or you receive the wrong item, please contact us promptly at droply.aus@gmail.com.
To help us investigate, please provide:
-
Your order number.
-
A description of the issue.
-
Clear photographs of the artwork and any damage.
-
Photographs of the packaging, where relevant.
Please retain the packaging where possible until the issue has been assessed.
We will work with you and the relevant artist or delivery provider to determine an appropriate resolution.
Your rights under the Australian Consumer Law apply regardless of any notification timeframe requested by Droply. Depending on the circumstances, you may be entitled to a refund, replacement or another remedy.

8. Change-of-mind returns
Please choose carefully when purchasing an artwork through Droply.
Because our collections feature original and often one-of-a-kind works, we do not offer change-of-mind returns as a standard policy.
This means we generally do not accept returns simply because you change your mind, decide the artwork does not suit your space or no longer wish to keep it.
This policy does not apply where you have a right to a remedy under the Australian Consumer Law, or where Droply expressly offers a change-of-mind return for a particular purchase.

9. Refunds and consumer guarantees
Droply takes its obligations under the Australian Consumer Law seriously.
Consumer guarantees apply to eligible purchases and cannot be excluded by these terms.
If an artwork has a major failure, you may be entitled to reject it and choose a refund or replacement, where appropriate and available.
For a minor problem, the appropriate remedy will depend on the circumstances and applicable law.
Where you are entitled to a refund, we will arrange it using the original payment method where reasonably possible. The time taken for funds to appear in your account may depend on your bank or payment provider.
Original artworks are not exempt from consumer guarantees simply because they are unique, individually made or sold as part of a limited collection.

10. Order cancellations
If you need to cancel an order, please contact Droply as soon as possible.
We will consider cancellation requests based on the order’s status and whether the artwork has already been prepared or dispatched.
Once an artwork has been dispatched, a change-of-mind cancellation may not be possible.
This section does not limit any cancellation, refund or other rights you may have under the Australian Consumer Law.

11. Artist information and artwork listings
Droply works with independent Australian artists and makes reasonable efforts to present their work accurately.
Artist biographies, artwork descriptions and other information help buyers learn about the artists and the work they create.
We aim to ensure that information supplied by artists and displayed on Droply is accurate and complete. If you believe an artwork listing contains an error, please contact us.
12. Copyright and ownership
When you purchase an artwork, you acquire the physical artwork, not the copyright in the image or artwork itself.
Unless expressly agreed otherwise in writing, copyright and associated intellectual property rights remain with the artist.
You may display your purchased artwork for personal use. You must not reproduce, distribute, commercially exploit or otherwise use the artwork in a way that infringes the artist’s intellectual property rights.
Droply’s website content, branding, photographs, graphics and written material are also protected by applicable intellectual property laws.

13. Website use
You agree to use the Droply website lawfully and not to interfere with its operation, misuse its services or engage in fraudulent activity.
We aim to keep the website accurate and available but cannot guarantee uninterrupted access or freedom from errors.
We may update website content, artwork listings and services as reasonably necessary.

14. Privacy
Your personal information will be handled in accordance with Droply’s Privacy Policy, available at [PRIVACY POLICY LINK].
Order information may be shared with the relevant artist or delivery provider where necessary to fulfil your purchase, arrange delivery or resolve an order-related issue, subject to applicable privacy laws.

15. Liability
Nothing in these terms excludes, restricts or modifies any right, guarantee or remedy that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or other applicable legislation.
To the extent permitted by law, Droply is not responsible for losses arising from circumstances beyond our reasonable control.

16. Changes to these terms
We may update these Terms & Conditions from time to time.
The applicable terms will be made available on the Droply website. Any changes will apply to future purchases and will not remove rights that have already accrued to buyers under applicable law.

17. Governing law
These terms are governed by the laws of Victoria, Australia, subject to any mandatory consumer protections that apply to your purchase.

Encourage intentional collecting

Provide artists with focused promotional opportunities

Allow artists time to create work specifically for each collection theme

Artists selected for a collection will receive theme announcements, submission deadlines, and launch timelines well in advance to allow adequate time for planning and creation.

By operating through seasonal releases, Droply aims to create a more meaningful and rewarding experience for both artists and collectors, with each collection feeling like a curated exhibition rather than an ongoing marketplace.

Artwork Listing Duration & Collection Structure
Droply operates through curated seasonal collections rather than permanent, always-changing listings. This approach is designed to create excitement around each launch while also ensuring artists have continued opportunity for sales over time.

Featured Collection Period
Each seasonal collection will be featured on the Droply homepage and actively promoted for a set launch period.
During this time, artworks will receive primary visibility across:
-
The Droply homepage
-
Email marketing campaigns
-
Social media promotion
-
Collection launch features
This is the main promotional period for each collection.

Post-Launch (Archive Listing)
Once a new seasonal collection is released, previous collections will move into the Droply Archive.
Works from past collections will:
-
Remain visible on the website
-
Continue to be available for purchase (if unsold)
-
Be clearly labelled with their original collection name and release date (e.g. “Small Wonders – October 2026”)
-
Receive lower promotional priority compared to the current featured collection
This ensures artworks continue to have long-term visibility beyond their initial launch period.
Why We Use This Structure
This model has been designed to support both artists and collectors:
For artists:
Provides strong exposure during launch periods
Allows artworks to continue selling after the featured window
Reduces pressure for immediate sales within a short drop period
Builds long-term visibility through ongoing archive presence
For collectors:
Creates excitement and urgency around new seasonal releases
Allows ongoing access to past collections they may have missed
Builds a growing library of discoverable artworks over time

Listing Duration
Unless otherwise agreed, artworks will remain listed on Droply for up to 12 months from the original release date.
After this period, Droply may:
Remove the artwork from sale, or
Offer the artist the option to renew the listing
Artists may also request removal of their work at any time with written notice, subject to any active orders or commitments.

14. Community Values
Droply is built on:
Creativity
Respect
Fair artist treatment
Community
Originality
Collaboration

We aim to build a platform where artists feel professionally supported, creatively inspired, and genuinely valued.
